Spectrum Software, Inc., warrants for a period of ninety (90) days from the date of purchase that the PRODUCT shall be free from defects in material and workmanship under normal use. EXCEPT AS EXPRESSLY STATED HEREIN, THE PRODUCT IS PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF PERFORMANCE OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. USER BEARS ALL RISK RELATING TO QUALITY AND PERFORMANCE OF THE PRODUCT. The performance of the PRODUCT varies with various manufacturers’ equipment with which it is used. Spectrum Software, Inc., does not warrant that the PRODUCT or the functions contained in the PRODUCT will meet USER’S requirements, operate without interruptions or be error free. The sole and exclusive remedy for breach of its limited warranty by Spectrum Software, Inc., shall be replacement of any defective medium upon its return to Spectrum Software, Inc., within the warranty period, or if Spectrum Software, Inc., is unable to
provide a replacement which is free of defect, refund of the license fee paid by the USER with respect to such a medium. In no case shall Spectrum Software’s liability exceed the amount of license fee paid.
Spectrum Software, Inc., in no event will be liable for any lost profits or other damages, including direct,
indirect, incidental, special, consequential or any other type of damages, arising out of this Agreement or
the use of the PRODUCT licensed thereunder, even if Spectrum Software, Inc., has been advised of prior
possibility of such damages.

The Spectrum Software website and the materials therein are provide AS IS. Spectrum Software, Inc., makes
no representations or warranties, either expressed or implied, of any kind with respect to the deecee.net site,
there operations, contents, information and materials. Spectrum software, Inc., expressly disclaims all warranties, expressed or implied, of any kind with respect to their site or their use, including but not limited to merchantability and fitness for a particular purpose. You agree that Spectrum software, Inc.,, its directors, officers, employees or other representatives shall not be liable for damages arising from the operation, content or use of deecee.net site.
You also agree that this limitation of liability is comprehensive and applies to all damages of any kind, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages.

In the event a product is listed at an incorrect price due to typographical error, Spectrum Software, Inc., shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Spectrum Software, Inc., shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Spectrum software, Inc., shall immediately issue a credit to your credit card account in the amount of the incorrect price.

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Spectrum Software, Inc., reserves the right at any time after receipt of your order to accept or decline your order for any reason. Spectrum Software, Inc., reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over $500.00 (U.S.) must obtain pre-approval with an acceptable method of payment, as established by Spectrum Software, Inc. We may require additional verifications or information before accepting any order.

Products may be returned to Spectrum Software, Inc., for replacement or refund in the following manner: Returns to Spectrum Software, Inc., must be made within 15 days of the invoice date. Any return of our software will be considered for refund only if it is unopened. Non-defective software that has been opened will not be accepted by Spectrum Software, Inc., for refund. Defective software may be returned for exchange with the same product only. You are responsible for shipping costs of all returns. All refunds for unopened software exclude shipping and handling charges. All refunds for unopened software will be charged a 15% restocking fee. Please allow 2-4 weeks for refunds to be processed and credited to your account. If you are seeking replacement of a defective product, you must place a new order for the identical product. When Spectrum Software, Inc., receives the returned defective product, you will be credited in full for the defective product plus the original shipping cost. In order to receive a refund, your purchase must be returned with shipping pre-paid. All defective software must be in "as-new" condition, in original packaging and with all registration card and manual. Any discrepancies could result in a delay or partial forfeiture of your refund.

You agree that any legal action brought against Spectrum Software, Inc., shall be governed by the laws of the State of Georgia without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the deecee.net site shall be an appropriate federal or state court located in Atlanta, Georgia.
